(Page 152) This Indenture Made this 22d day of September in the year of Our Lord 1767, Between John Stevens of the County of Anson & Province of North Carolina Planter of the one part & Andrew Shepherd of the County of Cumberland & Province aforesaid of the other part, Witnesseth that the said John Stevens for & in consideration of the sum of 25 pounds Proclamation Money to him in hand paid before the ensealing and delivery hereof the receipt whereof he doth hereby acknowledge & himself therewith fully satisfied contented & paid hath given granted bargained sold aliened enfeoffed conveyed and confirmed unto the said Andrew Shepherd one certain tract or parcel of land containing 150 acres lying & being in the County of Cumberland in the Province aforesaid on Fall Creek Beginning at a White Oak on the south East side of said Creek reputed the Earl Granvills line thence running South 31 chains & 63 links to a stake between a White Oak & a Pine thence West 31 chains & 63 links to a stake by a Red Oak thence North 31 chains & 63 links to the Earls line then with it to the beginning. To have and to hold the above bargained premises with every part & parcel thereof to him the said Andrew Shepherd his heirs & assigns forever & I the said John Stevens at the time of ensealing & delivery hereof am lawfully possessed of said land with its appurtenances in fee simple & in myself good right lawful authority & full power to sell & dispose of the said land improvements orchards & all & singular the appurtenances thereunto belonging in manner as aforesaid the same being freely acquitted exonherated & discharged of all manner of former gifts grants bargains sales leases & all manner of encumbrances whatsoever & I the said John Stevens for myself my Heirs executors & administrators do covenant & agree to warrant & defend the said land unto the said Andrew Shepherd together with all improvements houses orchards & all & singular the premises with the appurtenances thereunto belonging unto him the said Andrew Shepherd his heirs & assigns forever against the lawful claims & demands of him the said John Stevens or any other person or persons whatsoever lawfully claiming or to claim from by or under him the said John Stevens.
