James Braswell Heirs 1844

Drew Braswell Sr. decd. appears to be the son of James Braswell Jr., son of James, son of Susannah Burgess Braswell.


State of North Carolina ) To the Worshipful the Justices of the Court of Pleas & Quarter Sessions
Halifax County ) May Term 1844

We the undersigned Commissioners appointed by the Court of Pleas & Quarter Sessions of Said County having been duly sworn proceded on the 6th & after days of March & on the 13th & 14th day of May to divide & make partitions between & among ELIZABETH HARRELL, JAMES ELLIOTT & the Heirs of MARMADUKE BRASWELL, decd, & the Heirs of DREW BRASWELL, Senr., decd, tenants in common of the lands descended to them as heirs at Law of the deceased JAMES BRASWELL. Whereupon we have proceded to divide the land given to JAMES BRASWELL by DAVID BRASWELL equally between Said HARRELL & the heirs at Law: In said division JAMES HARRELL drew Lot No. 1 bounded as follows Viz Beginning at THOS. WEATHENSBERS corner a pine then N 3 1/2 E 88 poles to a corner Stake then N 82 ½ W 166 poles to the back line thence around Said line to the first station containing by estimation one hundred & fourteen acres more or less. The other half of Said tract of land containing one hundred & fourteen acres more or less we proceded to divide in four equal shares in Value so as to Set off & allot to ELIJAH BRASWELLs children their portion of Said Land (all the other rights having been previously purchased by JAMES HARRILL & required no division0: in Said division the heirs of ELIJAH BRASWELL drew Lot No. 4 which may be found by beginning at THOMAS WEATHENSBERS corner a pine then N 3 1/2 E 88 poles to a corner Stake thence N 82 ½ W 48 pole to a Stake then N 8 ½ E 19 poles, then N 85 W 46 pole then S 12 W 18 pole then S 82 ½ E 47 pole to the first beginning containing by estimation six acres more or less (Said Lot of land is lying nearly between where JAMES HARRELL now resides & a new house said HARRELL has lately built nearby all in the field. We then proceded to divide the lands given to SALLY BRASWELL by DAVID BRASWELL first between said SALLY BRASWELL & the heirs at Law in Said Division. SALLY BRASWELL drew Lot No. 1 beginning at a corner cedar & white oak on the road thence S 79 1/2 W 112 pole to a corner Maple on little swamp thence down the run of said swamp to JOHN DEVERUAX corner thence S 4 W 12 poles to WADE ELLIOTTs corner a pine thence N 88 ½ E 76 pole to Said ELLIOTTs corner pine stump then S 7 ¼ E 84 poles then E 17 pole to the road thence along the road to the first Station containing by estimation twenty seven acres more or less. Lot No. 2 drawn by the heirs at Law & divided first in four different Lots equal in Value. Lot No. 1 drawn by BOLIN, SALLY & RUTHA BRASWELL Beginning at a holly & red oak on the land, WHITMELL BRASWELLs corner thence West 68 eight 5 poles to JAMES ETHENUGAINs corner then S 6 W 26 poles to 2 pines a corner thence S 83 E 46 poles to the road thence along the Said road to the beginning containing Seven & a half acres more or less. Lot No. 2 was drawn by WHITMELL, POLLY & DREW BRASWELL & the children of ELIJAH BRASWELL beginning on the road a corner sweet gum then N 83 W 46 poles to 2 pines a corner then S 6 W 15 pole to a pine a corner then S 86 E 42 pole to the road then along the road to the begining containing three & three fourth acres more or less. Lot No. 3 was drawn by JAMES ELLIOTT beginning on the road at a corner pine thence N 86 W 42 poles to a corner pine then S 6 W 24 pole then S 83 E 37 pole to the road then along the road to the first station. Lot No. 4 was drawn by ELIZABETH HARRELL Beginning on the road at a corner gum then N 83 W 37 pole to the back line then S 6 W 52 pole to SALLY BRASWELLs line thence along her line to the road thence along the road to the first beginning containing ten acres more or less. The above mentioned Lots No `1 & 2 were only divided between the heirs of DREW BRASWELL, decd & the heirs of MARMADUKE BRASWELL decd. agreeable to the wish of the heirs. We further proced to divide the lands given to PHEREBE HARRELL & her heirs at Law. In said division PHEREBE HARRELL drew Lot No. 1 adjoining the land of JAMES HARRELL Beginning at a cedar & persimmon JAMES HARRELLs corner on the road thence N 88 E along said HARRELLs line 141 poles then S 2 W 34 poles then S 83 E 56 poles Callor & JAMES HARRELLs corner thence N 12 poles to the dividing line then N 86 12 W 204 poles to the road thence along the road to the first station containing fifty seven acres more or less. Lot No. 2 the part drawn by the heirs we first divided equally according to Value in two Lots. JAMES ELLIOTT & ELIZABETH HARRELL having previously sold their interest to JAMES HARRELL, JAMES ELLIOTT & ELIZABETH HARRELL drew Lot No. 2 Beginning at a post oak in the dividing line between PHEREBE HARRELL & THE HEIRS thence S 86 ½ E 121 poles to the back line then N 37 poles to a corner 3 maples in the possess then N 2 W 108 pole to a corner pine in BRASBYs line then N 22 poles to a corner pine formerly POLY BRAIANS then N 86 W 14 pole to a corner post oak then S 1 ½ W 56 poles to the lst station containing twenty eight acres more or less. Lot No. 1 was drawn by the heirs of DREW BRASWELL decd & the heirs of MARMADUKE BRASWELL decd, which being divided again BOLIN, RUTHA & SALLY BRASWELL heirs of MARMADUKE BRASWELL drew Lot No. 2 Beginning at a corner pine on the road between E. NELMS & others thence S 86 E 72 pole to a corner post oak in NELMs line then S 1 ½ W 28 pole to a corner in peresson then N 88 W 80 pole to the road then along the road to the first begining containing thirteen acres more or less. Lot No. 1 was drawn by WHITMEL, POLLY & DREW BRASWELL & the children of ELIJAH BRASWELL heirs of DREW BRASWELL decd & being divided again in four separate Lots WHITMELL BRASWELL drew Lot No. 1 Beginning at a corner persimmon on the road PHEREBE HARRELLs corner thence along the road N 13 E 6 pole then S 86 W 1/2 E 81 poles to the + dividing line containing three & one fourth acres more or less. Lot No. 2 was drawn by the children of ELIJAH BRASWELL Beginning at a small gum on the road then along the road N 13 E 6 poles to a corner gum then S 87 E 83 poles to the dividing line containing three ¼ acres more or less. Lot No,. 3 was drawn by POLLY BRASWELL Beginning on the road at a corner gum then c along the road N 13 E 6 poles to a corner thence S 86 E 84 poles to the dividing line containing three ¼ acres more or less. Lot No. 4 drawn by DREW BRASWELL Beginning at corner gum on the road thence along the road N 13 E 6 poles to a corner then S 86 E 80 poles to the divide line containing three & one fourth acres more or less. All which is respectfully submitted under our hands & Seals this 14th day of May 1844.

NB We would say in regard to that part of the petition which prays that the Defendants be required to account for the profits of the Land that we not been able to learn how much profit if any at all has accrued to the Defendants
